Cirrus Weather Solutions, LLC (“CWS”) offers the MemphisWeather.net and StormWatch+ apps (“Apps”) subject to these Terms of Use (“Terms”). The Apps and content therein are offered to you conditioned upon your acceptance without modification of the terms, conditions, and notices contained herein. The Apps are not marketed to, nor intended to attract persons under the age of 13. Installation and/or use of the Apps implies acceptance of all such terms, conditions, and notices. If you do not agree with the Terms, do not use the Apps.
CWS reserves the right to update the Terms at any time. Each time the Terms are updated, a new date will appear at the top and a summary of changes will appear below.
CWS reserves the right to make changes and improvements to the Apps, or discontinue the Apps or portions of the Apps at any time. By agreeing to these Terms, you agree that CWS is not liable for any change or discontinuation of the Apps.
The Apps provide information that is the sole responsibility of the entity from which the information was disseminated. This information is deemed timely, accurate, complete, and reliable, but is not guaranteed as such. CWS is not liable for any errors in such content.
You understand that, due to factors beyond CWS's control, an interruption in services provided by the Apps may occur. CWS will not be held liable for these or other events that prevent or delay data transmission and is not bound to provide you any monetary or in-kind reimbursement should an interruption in service take place. The Apps should not be used as a sole source of information regarding any weather event.
The Apps are for personal use only and are not for non-commercial use. Re-distribution of content provided by the Apps is forbidden.
You agree to not disrupt or interfere with the Apps, or services or networks facilitating their usage, nor violate any applicable local, state, or national law, irrespective of intention. You agree not to access or attempt access to the Apps or content therein using any automated systems or tools.
You accept responsibility for any activities that take place under your account. CWS takes extensive security measures to prevent unauthorized access to your account, but cannot guarantee absolute security to your account or its contents. You accept all risks of unauthorized access to information and data provided to CWS.
You agree that CWS may disclose your information 1) in cases of suspected abuse of the Apps or associated services, 2) to report, investigate, or facilitate investigation of fraudulent behavior or illegal acts, 3) when required to do so by law, 4) to comply with legal processes, 5) to protect rights, personal safety, or property of CWS, other users of the Apps, or the public. CWS will provide notice of such disclosure when possible.
The Apps offer the SW+ Alerts service. Usage of SW+ Alerts requires that you create a SW+ Alerts account. You agree that creation of a SW+ Alerts account is subject to the SW+ Alerts Privacy Policy and all terms therein.
Should you choose to buy a subscription to the SW+ Alerts service, you agree that 1) payment will be charged to your Apple ID account at confirmation of purchase, 2) the subscription renews automatically unless auto-renew is disabled at least 24 hours prior to the end of the current period, 3) you can manage and cancel your subscription by going to your account settings in the App Store after purchase.
You agree that CWS may immediately terminate your access to the Apps or services therein without prior notice. CWS may undertake such action for numerous causes including, but not limited to 1) violation of the Terms, 2) technical problems with services associated with the Apps, 3) requests by government agencies or law enforcement. You agree terminations are made in CWS’ sole discretion.
CWS hereby disclaim all warranties and conditions with regard to the Apps and associated services including all implied warranties and conditions of merchantability and fitness for a particular purpose. There are no warranties which extend beyond the description on the face hereof. CWS does not warrant against damages or defects arising out of the use of the Apps or associated services. No warranty of any kind, expressed or implied, is made regarding the safety of the Apps or content therein.
To the extent allowed by law, CWS shall not be held liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or connected with, the use or misuse of the Apps. You assume all risks and liability arising from the use of the Apps.
These Terms are governed by the laws of the state of Tennessee. You hereby consent to the exclusive jurisdiction and venue of the courts of Tennessee, in all disputes arising out of or relating to the use of the Apps.
